REGISTRATION: You must ensure that the details provided by you on registration or at any other time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
ENTRY DEADLINE: Valid confirmed entries must be received via any platform to the Game by 19.45 on 20th June 2004. Entries will not be permitted after this date. Any entries deemed by us to be received after the deadline will be invalid
ENTRY QUALIFICATION: The Game is only open to those aged 18 years or over at the time of registration and is open to any eligible person residing in a country where the Game is not prohibited or otherwise unlawful and has a mobile phone connected to a UK network. It is each entrant's responsibility to ensure that their entry into the Game is lawful. Failure to observe these terms and conditions will mean that any winning entry will be treated as not having been validly entered, and all prizes will be forfeited. Employees of Be The Boss Ltd and their families, agents and any person connected with the Game are excluded from entry.
ACCEPTANCE: Entries correctly submitted via the website or via text message will result in an acceptance message being sent to the mobile phone number submitted. The competitions computer's record of each entry will be deemed to be the official entry for each team. Entries will only be deemed valid upon full payment of any fees due. Any payment found to be invalid or not of the correct amount will mean that any winning entry is invalid and all winnings will be forfeited. Incorrect, incomplete or corrupted entries will not be accepted. The computer record of the entry will be considered to be the entry. The decision of Be The Boss Limited is final. Be The Boss reserve the right to refuse to accept any entry which, in their opinion, does not comply with the rules and regulations of the competition or which contravenes the spirit of the Competition. We further have an absolute discretion to disqualify any entry and participants agree that no liability shall be attached to Be The Boss as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any participant.
TEXT MESSAGES: The charge for entry via text message is £1.50p per entry + users standard network rate, and are set out on the Website and any other promotional or explanatory copy. By using this medium you agree to be bound by these Terms and Conditions. We reserve the right to vary the charges for entry via text message and details of the new charges will be set out on the Website and any other promotional or explanatory copy. You will be charged for each and every message received or requested and that charge will be added to the invoice you receive from your network operator or deducted from the credit you have on your mobile phone. In all cases entrants must supply all the information requested. Misrepresentation or fraudulent use of a mobile phone may invalidate an entry. Entrants entering by means of the Website will also incur their own cost (if any) of time spent accessing that Website
SELECTION: Entrants must choose a name for each team entered up to 11 characters long. The Promoter reserves the right to reject any team name that in its sole judgement is inappropriate or offensive. In such a case, the Promoter reserves the right to rename the team in the name of the entrant or to apply such other name as the Promoter deems appropriate. Entrants must select eleven players for each team. Entrants may enter as many teams to the Game as they wish, although each team entered should have a different team name. Only players listed in our official player list may be selected. The Promoter will not enter into any correspondence relating to the inclusion or non-inclusion of any player. Be The Boss reserve the right to change the code associated with any player at anytime.
SCORING: The score earned by each player is based upon actual actions performed during the match as recorded by the Opta Index and subject to the Be The Boss unique scoring mechanism. The promoter’s calculation of scores will be final and no correspondence will be entered into.
Details of the highest score for the Competition will appear on the Website. This is for information purposes only and is not confirmation of the winning of a prize. CONTACTING WINNERS: All winners will be notified via a text message to the winning mobile phone number or via their contact details given during their entry within 5 days of completion of each of the seven rounds of the Competition. If a winner cannot be located within three months, the prize will be forfeited. All prize winners will be announced within 7 days following the last Eligible Game of the relevant prize period. The winners agree to allow the free use of their names, photographs, general location and team name and selections for publicity, and each entrant consents to the use of their personal data for these purposes. The prizes are non-transferable and there are no alternative prizes. |
LIABILITY: In respect of the operation of the Competition and interpretation of the Terms and Conditions, our decision will be final and no correspondence will be entered into. We accept no liability for unauthorised or fraudulent use of mobile phones or mobile phone details. Proof of sending or transmission of an entry shall not be proof of receipt or acceptance of an entry. We do not accept liability for technical, hardware or software failures of any kind or lost or unavailable network conditions which may limit or prohibit the opportunity to participate in the Competition. We reserve the right to amend and/or waive the Terms and Conditions or any part thereof at any time and entrants agree that no liability shall attach to us as a result thereof, and that the exercise of such discretion shall not result in any compensation or payment being payable or paid to any entrant. It is a condition of entry of the competition that the Terms and Conditions and the latest promotional and explanatory copy which form part of these Terms and Conditions are accepted as binding and that the entrant agrees to abide by these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and any other promotional or explanatory copy, we shall be entitled in its sole discretion to determine which provisions shall prevail in order to resolve such discrepancy.
INTELLECTUAL PROPERTY: The content of the Service is protected by copyright, trade marks, database and other intellectual property rights. We may send you content as part of the Service which you may display on your mobile telephone, store in electronic form on your mobile telephone and keep one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials provided by us as part of the Service without our written permission.
GENERAL CONDITIONS: Be The Boss will make all reasonable efforts to ensure the accuracy of the information on the Website, and any other promotional or explanatory copy, and to update such information on a regular basis, but does not guarantee that such information will be accurate or up-to-date at all times. Any site users or managers found to be attempting or suspected of attempting to hack into any servers or systems run by Be The Boss will be immediately removed from the system. Such users will have no right to any refunds and Be the Boss reserves the right to report the matter to the relevant authorities. Although we aim to offer you the best service possible, we cannot guarantee that the Game will be fault free and available at all times. You may not use the Service for any of the following purposes:• damaging, interfering with or disrupting access to the Service or any other persons enjoyment of the service;• doing anything which may interrupt or impair the Service’s functionality;• breaching any laws concerning the use of public telecommunications networks; and• making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner. You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements, sums paid by us as a result of any settlement agreed by us arising out of or in connection with any claim by a third party that the use of the Service by you has resulted in loss and/or damage to be suffered by them. You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our control. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from the Act.
COMPLAINTS: Be The Boss reserves the right to investigate any complaints that it receives but shall be under no obligation to do so. Should we chose to exercise this right, our decision shall be final and binding on all complainants and we shall not enter into any correspondence regarding the decision or any other matter.
These Terms and Conditions will be interpreted in accordance with English law and the entrants agree that all claims they may have arising from their participation in the Competition which may be brought against Be The Boss will be under the exclusive jurisdiction of the English Courts.
